H-3 Visa
This visa permits visa-holders to stay in the US for a particular period and special education and training. The visa holder needs to get into a program which is not accessible in the home country. The program for which the visa holder is going should not be education related to a medical or complete advanced degree. The visa holder cannot work in the US. There is a limit of 50 applications allowed every year for this type of visa.
Visa holders can stay in the United States until the completion of the program. The validity of a visa for training programs is two years, but for special education, it is valid for eighteen months. Another thing to keep in mind is that this visa cannot be further extended.
Visa holders can apply for another type of visa as a visa holder is in the United States and wish to do a job once the program is complete. H-3 Visa holders are not permitted to apply for a Green Card.
There are also cases where an application for the H-3 visa is not accepted in the following scenarios:
* The visa holder intent to be employed in the United States.
* One has already finished the same training at home or the described program is common.
*Training program to be applied for this visa did not petition the time.
* The limit has been met.
US H-4 Visa—
H-4 visa is required by spouse and children under the age of 21 years of the H-3 visa holder who want to join the visa holder to the US. H-4 visa holders are not permitted to work in the United States, but if they find any employment, they may appeal to shift their visa status.
Time taken to process each application is not the same. The institute which welcomes you has to appeal for your visa at the minimum six months before the program is going to start. It normally takes four to six weeks for the appeal to be processed. After it has been processed, one may apply for an H-3 visa, which takes one to three months.
